Some of our services in this area include: IP portfolio analysis; vulnerability and risk-assessment counseling; IP procurement (patents, copyrights, trademarks) – domestic and international; marketplace IP landscape analysis; opinions: freedom-to-operate (clearance), patentability, invalidity, non-infringement, unenforceability; disclosure review and analysis; investor education programs; agreement drafting and review including non-disclosure agreements, licenses, and joint development agreements; and IP provisions relating to employee agreements, licenses and other agreements.

CASE STUDY 1:

The Challenge: An angel investment group requested that we evaluate the IP protection of a potential investment.

Services Provided: Hoffman Warnick conducted numerous interviews with the management of the potential investment, reviewed their IP position, and conducted a freedom-to-operate analysis.

Results: The client was warned not to make a $250,000 investment because the technology was unlikely to be protectable, and potentially infringed another firm’s IP.
